Terms and conditions regarding site fees

  1. NO REFUND OF PLOT FEES will be made to owners terminating their Licence or selling/removing their CHHs from the Park.
  2. All correspondence should be addressed to New Romney Caravan Park with payments by cheque made payable to HILLBOROUGH PROPERTIES LIMITED. Credit card payments carry a 2.5% surcharge.
  3. The first payment/instalment of Plot Fees for each CHH is payable by 6th December every year.
  4. The plot fee must be paid in full by 1st March each year(if either Option 1 or 2 has been taken up). If full payment is not received by that date, the Company is authorised to re-let the plot, de-site and move the CHH to the storage area.
  5. If a caravan is moved from its pitch by reason of non-observance of the Company’s Terms and Conditions or non-payment of fees due, a de-siting charge is payable. The current charge is £250.00 plus VAT, but will be increased if the CHH jacks or wheels have not been maintained in full working order, to include storage at a daily rate until removed from the Park.
  6. When a CHH is re-sited the owner will be charged for re-siting and reconnection to all services.
  7. If a CHH is disconnected from the services due to non-payment of fees (including any late payment charge), when the CHH is reconnected to the services, following settlement of all outstanding amounts to the Company, the Company will make a charge of £50.00 plus VAT for such reconnection.
  8. Electricity supply is by meter and will be charged at the current rate at the end of October each year.
  9. The Company does not guarantee any particular plot to any CHH owner and reserves the right to move any CHH at any time should it be considered necessary.


Terms and conditions for the issue of site licences

LICENCES are granted subject to the following conditions and regulations which have evolved to ensure that everyone benefits from the orderly and smooth running of the Park.

  1. The granting of a licence for a plot for a Caravan Holiday Home (CHH) is personal to the applicant signing the licence application form and merely gives him/her a licence to place the caravan detailed on the form on a plot, subject to the terms and conditions on this form and the site rules, and no interest in any land is thereby granted to the applicant. Neither the plot nor any rights of way thereof are transferable or assignable or capable of being dealt with in any way by those to whom they are granted and the right is reserved to terminate the licence of any pitch on 24 hours’ notice being given in writing.
  2. The siting of the CHH is at the discretion of the Manager.  
  3. Licences are granted by the Company at its discretion to run between 1st April or Easter, whichever is the earlier, to 31st October and from 1st November until 31st March for a 7 month licence  (This period being the closed season). Alternatively the license may run from March 1st, to November 30th and from 1st December to 28th Febuary (This period being the closed season) for a 9 month license.

  4.  Licences are granted to purchasers of CHHs through the Company’s sales organisation. Licenses may also be granted to CHHs from other parks, at the Manager's discretion, subject to appropriate charges.

  5.  The Company has absolute right to require the removal of a CHH at any time and also to refuse to renew any licence.

  6.  A licence is for a specific plot only and any request to move should be discussed with the Manager. Any movement of the CHH will be subject to an appropriate charge.

  7.  No licence can be issued until the total fee is received by the Company, which must be by 1st March and no CHH may be occupied until all fees are paid.

  8.  Preference of plot is always given to licencees of the previous season but the Company reserves the right to move a CHH to an equivalent site or to refuse to renew a licence.

  9.  The CHH may not be used as a business address, shop for the sale of goods, or for any form of advertising – this includes "FOR SALE" signs.

  10.  The caravan must be clearly numbered.

  11.  The licensee should not cause or permit any nuisance noise or annoyance to any other owners on the Park or adjoining CHH or to the Company. Parents are reminded that they are responsible for the behaviour of their children. It is their responsibility to ensure that their children do not cause any nuisance noise or annoyance to any other people on the Park.

  12.  Licence transfers are not permitted unless authorised by the Manager and the relevant fee is paid.

  13.  NON PAYMENT OF SITE FEES – if fees are not received by the due date the Company may give notice to the licensee to remove the CHH. If after 28 days’ such notice to the last known address of the licensee the CHH has not been removed, the Company reserves the right to move the CHH to a storage area. Charges will be made for removal and storage. Alternatively the Company may sell the CHH and reimburse themselves for any expenses from the proceeds of the sale.  Late payment charges will be applied to all outstanding invoices. 

  14.  DE-SITING charges will aply to all CHH being removed from the Park to another address.

  15. INSURANCE – CHH owners must fully insure their caravans.

  16.  The licensee is responsible for all his property left in or about his CHH.

  17.  The licensee is responsible for the draining down of all services in his CHH and for its protection from frost. The Company offer this service reference tick box on Plot Licence Application.

  18.  The licensee is responsible for his CHH security which includes maintenance of INSURANCE APPROVED ground anchors ( the fitting of which may only be carried out by the Company), chassis and wheels.
  19.  All CHH must be equipped with functioning smoke alarms and fire extinguishers. In the event of default the Company reserves the right to supply and fit suitable appliances at the licensee’s cost and to charge accordingly for payment within 30 days.

  20.  DOGS – Only dogs owned by Licensees will be allowed on the Park provided that the Company is notified, the dogs are kept on a lead, walked in designated areas only, and the bins provided for dog waste are used. In the interests of hygiene no dogs will be allowed in the Clubhouse.

  21.  Licensees are responsible for cutting the grass in 2 feet from their CHH as and when necessary, and whenever required by the Company. If Licensees fail to mow this area the Company will do this and charge accordingly. Gardens should not be planted further than 4 feet from the caravan.
  22. The area between CHHs should be kept clean when not being used.  Please remove garden furniture, windbreaks etc to enable the maintenance of the grass.
  23. Licensees are responsible for maintaining the exterior of their CHH. If a Licensee fails to keep their CHH clean, the Company will do this and charge accordingly. 
  24.  No part of the plot on which any CHH is sited may be used for the storage of goods in the open.

  25.  In order to maintain a tidy and well-organised Park, any plans to erect boxes steps  verandas fences or any other attachments to the caravan must be referred to the Manager.

  26. THE ELECTRICITY BOX outside the CHH is the property of the Company and is restricted to 16 amps, and should not be tampered with. Any overloading is the responsibility of the licensee and the re-setting of fuses will be charged. It is recommended that the Company is contacted to advise on the suitability of any electrical appliances.
  27. No more than two gas cylinders are permitted per CHH, which may be secured together, but not to the CHH.
  28. Ball games, swing ball and kite flying may only take place in designated areas.
  29.  An adult should accompany children under 6 years old who are using the toilets.
  30.  CYCLING IS ALLOWED ON THE ROADWAYS BETWEEN 8am AND 6pm. PARENTS ARE PARTICULARLY ASKED TO HELP IMPLEMENT THIS RULE TO INSTIL INTO THEIR CHILDREN CARE AND CONSIDERATION FOR OTHER PEOPLE ON THE PARK.

  31.   Any work required to be carried out by the Company’s staff must be arranged through the office. Ground staff should only be directly approached in an emergency.

  32.   Laundry and drying facilities are provided and no laundry may be hung around CHHs.

  33.  ONE CAR IS PERMITTED WITH EACH LICENCE. Parking must be in an orderly manner, not on the service roads or grass. No parking will be allowed between caravans. Sleeping in cars is not permitted.

  34. ALL vehicles on the Park MUST have VALID MOT, INSURANCE AND TAX. Failure to comply will mean removal of the Vehicle or termination of your Licence.

  35. Learner drivers are not permitted to drive on the Park.

  36.  LETTING OF CARAVANS

  37. Dogs are also permitted on the Park provided that they are kept on SHORT leads. They must not be allowed to soil the ground within the Park – accidents must be cleared up immediately. Dogs can be exercised on the extensive dog walking area.

    Dogs must be supervised AT ALL TIMES on the Caravan Park. This rule will be strictly enforced.
     

  •  A copy of this document should be on display in all caravans which are let or used by other people than the Licensee.

  •  DOGS WILL NOT BE ALLOWED IN LETTING CARAVANS.

  • Sub-letting or loaning, which includes members of the licensee’s family staying without the licensee being present, is not permitted without prior notification in writing to the Company. Licensees must ensure that their guests are aware of and abide by these rules. Guests who wish to use the club must give 48 hours’ notice by completing an application form.

  •  Letting to groups of teenagers is not permitted, and teenage members of the licensee’s family may only stay without adults if permission is given by the licensee and shown to the Company in advance.

  •  The Company reserves the right to refuse admission to the Park to any person or property.

  •  If, in the opinion of the Company, the occupants of any caravan are considered undesirable, the Company reserves the right to remove them from the Park forthwith. The licensee is liable to pay any costs incurred in such removal, and for any damage on the Park.

 Sale of CHH on site

  •  Owners may sell their CHHs on Park to a third party who has been approved by the Company.

  •  Before the CHH can be sold to the third party it must be offered in writing direct to the Company at the price to the third party less a discount of 15% plus VAT. The Company has 7 days in which to accept this offer.

  •  If the Company declines the offer and there is a subsequent alteration in price the CHH may not be sold unless it is re-offered to the Company at the revised price subject to the 15% discount plus VAT. The Company again has 7 days to accept.

  •  CHHs being sold to a third party will only be approved providing the CHH is under 10 years old.  Commission is payable to the Company at the rate of 15% of the selling price plus VAT by the new owner direct to the Company.

  •  It must be understood and agreed that there will be an infrastructure charge payable by the new or existing owner to the Company. 
  • . Nothing shall be done caused or permitted to be done upon the Park which would constitute a breach of any of the conditions subject to which the Plot Licence is from time to time issued. In the event of the PlotLicence being revoked for any reason, this licence shall terminate forthwith and the licensee shall as soon as practicable remove his/her CHH and all other goods and possession from the Park and shall leave the plot on which the CHHwas sited in a neat and tidy condition.

ABUSE AND THREATENING HEHAVIOUR TOWARDS STAFF WILL NOT BE TOLERATED AND WILL RESULT IN THE TERMINATION OF THE PLOT LICENCE.

THE COMPANY OR ITS REPRESENTATIVE WILL HAVE FULL POWER TO ACT IN ACCORDANCE WITH THESE CONDITIONS AND REGULATIONS.

Any matter not dealt with in the foregoing will be dealt with at the discretion of the Company whose decision will be final and binding on all parties.
